Article 4: Conduct

4.1 In the discharge of the constitutional mandate under paragraph five of the Sixth Schedule to the Constitution, each Commissioner shall respect the Constitution and comply with the requirements of the Kenya Law Reform Commission Act, the Leadership and Integrity Act and all other relevant laws. In particular, each Commissioner undertakes—

a) to exercise due care and diligence in fulfilling the function of office;

b) to use the powers of office in the best interests of the public;

c) prohibit personal interests or the interest of any person associated with him or her to conflict with the interests of the Commission and the public at large;

d) to be independent in judgment and actions and to take all reasonable steps to be satisfied as to the soundness of all decisions taken by the Commission;

e) to ensure that confidential information received in the course of the exercise of duty as a Commissioner remains the property of the Commission which should not be disclosed unless such disclosure is authorized by law;

f) not make improper use of information acquired as a commissioner; and

g) not engage in conduct likely to bring discredit upon the office held.
